A doublewide has a clear title but the land has a mortgage lein against it. The title never was filed with a lein only the property. with a clear title can the doublewide be moved or sold since the title is clear and the mortgage company failed to file a lein against the home. also the original mortgage papers has the property listed in a different county than where the property actually lies. thank you
In the State of Michigan, a ‘doublewide’ would refer to a mobile home or trailer. Being that, the title to it would be the same as a car or motorcycle. It would not be something a Title company would check & insure a deed or property transfer for. The Secretary of State would do the ‘title transfer’. Now the lot, would be ‘tangible property’ & be subject to ‘regular’ real estate (unlike a mobile home), that could be why the land had a lein & not the ‘house’. Keep in mind that the ‘home’ could be picked up & moved to another piece of land. Try doing that to a brick & mortar / stick built property. That is exactly why the lien would be on a ‘parcel’ that is ‘fixed’ onto a permanent spot. (also, try moving the land).So, if you want to move the doublewide, check with the ‘park’ & municipality (city / township).
