[dropcap2]A[/dropcap2]Do you have a signed & accepted purchase agreement (signed by all parties)? Did he sign the purchase agreement with you? What contingencies does that agreement have written into it. If you did sign an agreement, the language contained in that agreement will spell out your remedies. It is possible that you will have to forfeit the money. If you didn’t sign an agreement, then you should be able to get your deposit refunded. If in doubt, meet & discuss with the agent or their Broker/ Manager.
