Another Person’s Lien On Our Property

[dropcap2]Q[/dropcap2]My husband was given some land recently. The land was part of a larger tract that was replotted and quitclaimed to him. The original tract, which included the smaller tract has a mortgage lien on it. The person who gave the land to him just took out a home equity loan. This lien is apprearing on my husband’s land too. Can the person who gave the land continue to take out home equity loans to keep a lien on the property to prevent him from selling it?

[dropcap2]A[/dropcap2]Shouldn’t be able to. However, depending on what your ‘written agreement’ states, they might. As soon as you can, take all the papers involving this property & meet with a Real Estate Attorney. Time could be of the essence. Think of a worst case scenerio – they stopped payinf on those loans & the property fell into foreclosure – YIKES! Make your appointment right away.
