Question: We r selling our house that is now being rented … the house is pending… When do our renter have to be out of the house… this is a short sale and we live out of state.. We already served them with a notice to quite .. renters were suppose to be out by dec 18.. they havnt moved yet… r we responsibe to get them out of the house befor the sale is final? it is winter here and we cant afford to take over heating so pipes wont freeze.. our realtor is pressing us to evict renters.. we dont have money for court fees and travel to court..
Answer: Your contract should state if the tenants have to be out prior to closing. Seems like your agent thinks they do. How close are you to the actual closing? That date should be your target / goal to have them out. Ask your agent for assistance.
