Deed to be registered

Q: When does the Deed to a house HAVE to be registered in the county of which it is in?

A: While a deed is not required to be recorded, it is the best move for all parties concerned to do so. It is recorded in the county where the property is located.

Is deed public knowledge ?

Q: how can you find out the previous house owners title insurance company? is it the deed public knowledge

A: If you get a copy of the deed, which is public information & available at the county records department, it might indicate a title company. They would be the preparer or possibly the notary. Other than this, ask your Realtor to see what company was involved in the last sale. Most companies use the same title company & by finding out what company was the listing company at the time of the last sale, you will probably also find the title company.

Remove name from deed

Q: My husband and I found a house together. By the time we were able to move into it, we had separated. We are now closing on the house and the loan is in his name only. Do I have to sign the papers on the new house since we are married? I have asked my realtor to remove my name from the deed and she said that she could not because of Oklahoma law.

A: Sorry to say, due to differences in laws state to state, & each person’s individual circumstances, you will need to follow the advice & direction of your attorney.If you don’t have one at this time, at least consult with one before more time goes by.

Add name to the deed

Q:  If someone purchases a house for me and does not put my name on the deed, can my name be added to the deed after the closing?

A: After the closing, you can have your (or anyone’s) name added to the deed / title. This does not have anything to do with an obligation to a mortgage company / bank that possibly financed the property. The person who took out the loan is still responsible for that.

Never got deed to house

Q: We’ve paid our house off over 2 years ago and still have not received the deed. went to the county and they told us is has been recorded but the deed is with some company. i contacted them and was told they are working on it. working on what ???? is there someone i could contact to ask for help with this matter.

A: This can be followed up by you, but will take much time & patience. I would get in contact with a real estate attorney to take over & get it done completely & correctly.

Home after death

Q: THE OWNER DIES SUDDENLY AND THE HOUSE IS IN HIS NAME. THE HOUSE IS PAID IN FULL. CAN THE HOUSE BE SOLD OR DOES THE CERTIFICATE OF TITLE HAVE TO BE RE=ISSUED IN THE SURVIVING CHILD’S NAME.

A: From what you wrote, it sounds like the property has to go through probate court. This type situation is exactly why these type details should be worked out in advance & there are many ways to do so.  Contact an attorney to get the process started.
